Terms of service

You own what you bring and what you make, and we do not use it to train AI models or sell it. Your writing is sent to our AI provider (Anthropic) only to generate your drafts, under commercial terms that forbid training on it. How we handle, store, and protect your data is set out in full in our Security overview and our Privacy Policy, both of which are part of these terms.

“Service” means the unwrite application and website. “Content” means what you provide: your voice samples, sources, briefs, and positioning. “Output” means the drafts the Service generates for you. “You” means the person or organization using the Service.

You must be at least 18, or the age of majority where you live, and able to form a binding contract. You are responsible for your account, for keeping your credentials secure, and for all activity that happens under it. Tell us promptly if you suspect unauthorized use.

We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own writing, personal or commercial. You may not resell, sublicense, or share your access, or use the Service to build or train a competing product.

unwrite is an authenticity tool, not a concealment tool. You agree not to:

• reverse engineer, scrape, or attempt to extract or discover the editorial engine, its methodology, or the system prompts behind it;
• use bots or automation beyond normal use, or circumvent rate or plan limits;
• generate unlawful, infringing, defamatory, harassing, or deceptive content, or content you do not have the rights to base on your uploaded sources;
• misrepresent authorship where disclosure is required, such as academic work under an honor code;
• use the Output in a way that violates a third party’s intellectual property, privacy, or other rights.

You own what you bring and what you make: your Content and your Output. We claim no ownership and you are free to publish under your own name.

You grant unwrite a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, and process your Content and Output solely to operate, maintain, and provide the Service to you, including sending it to our AI provider to generate your drafts. We do not use your Content or Output to train, retrain, or improve AI models, ours or anyone else’s, and we do not sell it. Your prompts and generated text are processed by our AI provider (Anthropic) under commercial terms that forbid training on them and that provide for limited retention. You are responsible for having the rights to the sources you upload.

We retain your account data and generation history only for as long as your account is active or as needed to provide the Service. You may request permanent deletion of your account and its associated Content at any time by contacting us at hello@unwrite.ai.

The Service, including the software, the unwrite brand, and the proprietary editorial methodology, is owned by unwrite and protected by law. We reserve all rights not expressly granted. The methodology and system prompts are trade secrets; attempting to extract, copy, or reverse engineer them is a violation of these terms.

unwrite™ is a trademark of unwrite, Inc. Trademark applications for the unwrite wordmark are pending in the United States and the European Union. We also claim rights arising from use in our other marks, including the amber cursor mark, whether or not an application has been filed or a registration granted in a given territory.

Nothing in these terms gives you a license to use our marks. You may use the name unwrite to refer to the Service accurately, in plain text, for example in a review, a comparison, or a description of how you made something. You may not use our marks in a way that suggests we endorse, sponsor, or are affiliated with you or your product, and you may not use them in your own product name, logo, domain name, or app store listing, or alter them.

If you believe someone is using our marks improperly, or you want permission for a use this section does not cover, write to hello@unwrite.ai.

The Service uses third-party foundation models and APIs, including Anthropic’s Claude, to generate your drafts. All Output is provided on an “as is” and “as available” basis. The editorial engine is designed not to fabricate, and the Service cites only the sources you provide or that it researches and checks. Even so, AI models can make mistakes and can produce incorrect, incomplete, or misleading information, sometimes called “hallucinations.” We do not guarantee, warrant, or represent that the Output will be accurate, complete, factual, error-free, or fit for your specific legal, financial, or commercial purposes.

Output is a drafting tool, not a final or verified document. You assume full and exclusive responsibility for reviewing, editing, verifying, and fact-checking all Output before you publish, distribute, or otherwise rely on it. The Editorial Review and the mechanical checks are aids, not guarantees.

The Service is designed to generate original text, but we make no representation or warranty that the Output does not infringe the intellectual property, copyright, trademark, or other proprietary rights of any third party. You assume all legal and financial risk associated with publishing or commercially exploiting the Output, and unwrite is not liable for any third-party infringement or plagiarism claim arising from your use of it.

Some features require a paid subscription. Plans, prices, and limits, such as the number of credits per month, are shown on the pricing page. Paid plans are billed in advance and renew automatically each period through our payment processor until you cancel.

You can cancel at any time and keep access through the end of the current paid period. Fees are non-refundable except where the law requires otherwise. You are responsible for applicable taxes. We may change prices with reasonable advance notice; a change takes effect on your next renewal.

Paid plans can also purchase one-time credit top-ups. Top-up credits are a one-time purchase, not a subscription: they never expire while your account is open, are consumed only after your monthly plan credits, and, like other fees, are non-refundable except where the law requires otherwise. Unused top-up credits have no cash value and are forfeited if your account is closed.

We may collect and use de-identified, aggregated data about how the Service is used to operate, secure, and improve it. This never includes your Content or Output in identifiable form. The Privacy Policy explains this in detail.

The Service relies on third parties, including an AI model provider (Anthropic) and a payment processor, and its availability and functionality depend on their uptime, performance, and API policies. Your use may be subject to their terms, and their outages or changes can affect the Service. To the extent permitted by law, we are not liable for service interruptions, data loss, or business disruption caused by the downtime, rate-limiting, or termination of services by our third-party providers, and we are not responsible for third-party products you separately choose to use.

Each party may receive non-public information from the other. The receiving party will protect it and use it only to perform under these terms, except as required by law.

Our Privacy Policy explains how we handle personal data and is part of these terms.

The Service is provided “as is” and “as available,” without warranties of any kind to the extent permitted by law, including warranties of accuracy, fitness for a particular purpose, or uninterrupted availability.

To the maximum extent permitted by law, in no event will unwrite, its founders, directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, goodwill, data, or business interruption, arising out of or related to your use of, or inability to use, the Service or its Output.

Our total aggregate liability for any claim arising from these terms or your use of the Service will not exceed the greater of (i) the total fees you paid unwrite in the three months immediately before the event giving rise to the liability, or (ii) one hundred U.S. dollars ($100.00). This limit applies whether you use a free, trial, or paid tier of the Service.

You will defend and indemnify unwrite against claims arising from your Content, your Output, your use of the Service, or your violation of these terms or of a third party’s rights.

You can stop using unwrite and delete your account at any time. We may suspend or end access for a serious or repeated violation of these terms, or to protect the Service or its users, and where practical we will tell you why.

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Before bringing a formal claim, you agree to first try to resolve the dispute informally by contacting hello@unwrite.ai, and we will do the same. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Delaware. You consent to the jurisdiction of those courts and waive any objection to the exercise of jurisdiction over you and to venue in them.

We do not use your Content or Output to train AI models. If that ever changes, users in the EU and UK will be able to object, and we will update this section and notify you first.

We may update these terms. For material changes we will update the date above and notify account holders. Continuing to use the Service after a change means you accept the updated terms.

These terms are the entire agreement between you and unwrite about the Service. If a provision is unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor, for example in a merger or sale. You agree to comply with applicable export-control and sanctions laws.
